1. Acceptance of these Terms
These Terms of Use govern your access to and use of SnapStudios, including our website, software, galleries, and related services (collectively, the "Service"). By creating an account, using the Service, or submitting information through this website, you agree to these Terms. If you do not agree, do not use the Service.
2. The Service
SnapStudios provides studio-management and photo-delivery tools for professional photographers. Features may include client management, contracts, scheduling, image culling, gallery delivery, and face-matching tools. We may change, improve, suspend, or discontinue features when reasonably necessary.
3. Accounts and access
You are responsible for providing accurate account information, safeguarding your login credentials, and for activity carried out through your account. You must notify us promptly if you believe your account has been accessed without authorization. You may not share, sell, or transfer access to your account except where we explicitly allow it.
4. Your content and permissions
You retain ownership of the photographs, client information, and other content you submit to the Service. You grant us the limited rights needed to host, process, display, transmit, and back up that content in order to provide the Service. You represent that you have all rights, permissions, notices, and consents required to upload and process your content, including any required consent for biometric or facial-recognition features.
5. Acceptable use
You may not use the Service unlawfully; infringe another person's rights; upload harmful code; attempt to gain unauthorized access; interfere with the Service; scrape or reverse engineer it except where law permits; or use the Service to process content that is illegal, abusive, or deceptive. We may suspend or terminate access where we reasonably believe these Terms have been breached.
6. Fees and subscriptions
Paid plans, billing periods, storage allowances, taxes, and any overage charges are shown at purchase or in your account. Fees are due in advance unless stated otherwise. You may cancel according to the plan terms, but payments already made are non-refundable except where required by law or stated in writing by us.
7. Privacy and data protection
Our collection and handling of personal information is described in our Privacy Policy. You are responsible for providing any notices and obtaining any consents required for the personal information and photographs you upload. Do not use face-matching or similar features where they are prohibited or where you lack the required consent.
8. Intellectual property
The Service, its software, branding, design, and documentation are owned by SnapStudios or its licensors and protected by applicable intellectual-property laws. Except for the limited right to use the Service under these Terms, no rights are granted to you.
9. Disclaimers and limitation of liability
The Service is provided on an "as is" and "as available" basis. To the extent permitted by law, we disclaim warranties that are not expressly stated in these Terms. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim related to the Service will not exceed the amount you paid us for the Service in the 12 months before the claim arose.
10. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on this page or otherwise communicated to you. Continued use of the Service after an update takes effect means you accept the revised Terms.
